School Admissions Contract

1. General

1.1 Purpose: This Contract establishes the fundamental framework for the educational relationship between Thari-Imbeleko Christian School (TICS) and the Parent(s) or Guardian(s) of the student. The purpose of this Contract is to set forth the rights, responsibilities, and obligations of both parties, ensuring the smooth and productive operation of the student’s education within the School for the 2024 academic year.

1.2 Admission: Admission to TICS is a privilege, and it is granted upon the acceptance of the School’s policies and procedures, as outlined in this Contract and the official School handbooks. The Parent(s) or Guardian(s) understand that compliance with South African laws and regulations governing private schools is a fundamental aspect of this Contract. It is imperative that the Parent(s) or Guardian(s) ensure that the student complies with these regulations throughout their enrollment at TICS.

1.3 Change of Terms: The School reserves the right to make changes to the terms and conditions outlined in this Contract. Any changes will be made in compliance with applicable South African laws and regulations. The School will provide prior written notice to the Parent(s) or Guardian(s) regarding any such modifications. It is the responsibility of the Parent(s) or Guardian(s) to review and acknowledge any changes as communicated by the School.

1.4 Communication: Effective communication between the School and the Parent(s) or Guardian(s) is of paramount importance. Regular communication channels, such as parent-teacher meetings, newsletters, and official notices, will be established to keep the Parent(s) or Guardian(s) informed about the student’s progress and any important updates or events within the School community.

1.5 School Mission: TICS is committed to providing a high-quality education rooted in Christian principles. The School’s mission is to nurture students’ intellectual, social, and moral development, equipping them to become responsible and compassionate individuals who can positively impact society.

1.6 Community Engagement: TICS encourages active involvement from the Parent(s) or Guardian(s) within the School community. This can include participation in parent-teacher associations, school events, and volunteering opportunities. A strong partnership between the School and the Parent(s) or Guardian(s) is essential for the holistic development of the student.

 

2. Fees

2.1 Tuition and Fees: The financial aspect of a student’s enrollment is a critical consideration for both the School and the Parent(s) or Guardian(s). The Parent(s) or Guardian(s) agree to pay all applicable tuition fees and other associated charges, as determined by the School’s fee structure. These fees are designed to cover the cost of education, administrative expenses, and facilities maintenance, all of which are integral to providing a high-quality learning environment for the student.

2.2 Payment Schedule: Recognizing the importance of financial planning, the School will provide the Parent(s) or Guardian(s) with a clear and comprehensive payment schedule. This schedule will outline due dates and the specific amounts that must be paid. It is the responsibility of the Parent(s) or Guardian(s) to adhere to this schedule.

2.3 Late Payment: The School operates within a budget, and timely payments are crucial to its continued operation. The Parent(s) or Guardian(s) are expected to ensure that all fees are paid by the specified due dates. Late payments may incur penalties, as outlined in the School’s fee structure or financial policies. Repeated late payments or non-payment may affect the student’s enrollment status, and the School may take appropriate action to address these issues.

2.4 Financial Aid: Thari-Imbeleko Christian School (TICS) is committed to providing access to quality education for all students, regardless of their financial circumstances. The School may offer financial aid, scholarships, or fee reductions based on the availability of resources and in accordance with the School’s financial aid policies.

 

3. Responsibilities

3.1 School Responsibilities: TICS will provide a high-quality educational program, maintain a safe and nurturing environment, and communicate regularly with Parent(s) or Guardian(s) regarding the student’s academic progress and overall well-being.

3.2 Parent(s) or Guardian(s) Responsibilities: The Parent(s) or Guardian(s) are responsible for ensuring that the student attends school regularly, participates in school activities, and abides by the School’s policies and code of conduct.

 

4. Conduct

4.1 Code of Conduct: The student is expected to adhere to the School’s Code of Conduct, treating fellow students, staff, and all members of the School community with respect and courtesy.

4.2 Discipline: The School has the right to take disciplinary actions, as outlined in the School’s disciplinary policies, in response to student misconduct.

 

5. Termination

5.1 Withdrawal: The School recognizes that circumstances may change for the Parent(s) or Guardian(s or the student during the course of the academic year. In such cases, the Parent(s) or Guardian(s) may choose to withdraw the student from TICS. A formal written notice of withdrawal must be provided to the School’s administration. The notice period for withdrawal will be specified in the School’s withdrawal policy. The Parent(s) or Guardian(s) are encouraged to communicate with the School in advance to ensure a smooth transition.

 

6. Personal Information

6.1 Personal Data: In the course of the student’s enrollment at Thari-Imbeleko Christian School (TICS), the School will collect and maintain certain personal information about the student. This information includes, but is not limited to, the student’s name, contact information, academic records, and any health-related information necessary for the student’s safety and well-being. The School is committed to handling this information with the utmost care and respect for privacy.

6.2 Data Protection: The School is dedicated to safeguarding the privacy and confidentiality of the student’s personal data. The collection, storage, and use of this information will be conducted in compliance with the School’s Privacy Policy, as well as applicable South African data protection laws. Any data collected will be used solely for educational and administrative purposes.

6.3 Parent(s) or Guardian(s) Consent: By signing this Contract, the Parent(s) or Guardian(s) provide explicit consent for the School to collect and utilize the student’s personal information for legitimate educational purposes, including academic record-keeping, communication, and ensuring the student’s safety and well-being while on School premises.

6.4 Security: The School will implement appropriate security measures to protect the confidentiality and integrity of the student’s personal data. This includes measures to prevent unauthorized access, disclosure, alteration, or destruction of this information.

6.5 Access and Amendment: The Parent(s) or Guardian(s) may request access to the student’s personal information, as well as request amendments or corrections when necessary. The School will ensure procedures for making such requests and will respond within a reasonable time frame in accordance with applicable data protection laws.

 

7. Indemnity and Waivers

7.1 Indemnification: The Parent(s) or Guardian(s) recognize that sending the student to Thari-Imbeleko Christian School (TICS) involves inherent risks associated with various activities and interactions within the educational setting. As such, the Parent(s) or Guardian(s) agree to indemnify and hold harmless the School, its employees, agents, and representatives from any liability, claims, damages, or expenses that may arise in connection with the student’s enrollment at the School. This indemnification extends to activities such as field trips, school-sponsored events, and any actions taken by the School in accordance with the policies outlined in this Contract.

7.2 Waivers: The Parent(s) or Guardian(s) understand that educational institutions, including Thari-Imbeleko Christian School (TICS), must make decisions that ensure the safety and well-being of all students and maintain an effective learning environment. To this end, the Parent(s) or Guardian(s) waive any rights to initiate legal actions or claims against the School, its employees, agents, and representatives, for actions taken in accordance with this Contract or the School’s established policies. This waiver includes, but is not limited to, disciplinary actions, academic decisions, and actions taken to maintain a safe and respectful school community.

7.3 Safety and Responsibility: It is understood that the School’s actions are motivated by a commitment to the student’s safety, development, and the welfare of the broader school community. The Parent(s) or Guardian(s) acknowledge that, to fulfill these responsibilities, the School may need to take measures that could result in the student’s discipline or consequences. This section underscores the importance of clear communication and collaboration between the School and the Parent(s) or Guardian(s) in fostering a safe and productive educational environment.

 

8. Disputes

8.1 Dispute Resolution: In the event that disagreements, conflicts, or disputes arise between the Parent(s) or Guardian(s) and Thari-Imbeleko Christian School (TICS) related to this Contract, the parties commit to seeking resolution through amicable and constructive means.

8.2 Negotiation: The first step in resolving any dispute shall be negotiation, with the aim of reaching a mutually agreeable solution. Both parties agree to engage in good faith discussions to address the issue at hand.

8.3 Arbitration: If a resolution cannot be reached through negotiation, both parties consent to binding arbitration as the next step in the dispute resolution process. Arbitration will be conducted in accordance with South African laws and regulations, and both parties will abide by the arbitrator’s decision, which will be final and binding.

8.4 Legal Recourse: The Parent(s) or Guardian(s) acknowledge that pursuing legal action against the School should be considered a last resort and, if necessary, will be subject to the applicable laws of South Africa. The parties agree to bear their own legal costs in the event of legal proceedings.

8.5 Confidentiality: Throughout any dispute resolution process, both parties agree to maintain the confidentiality of all discussions, negotiations, and arbitration proceedings.

8.6 Cooperation: Both Thari-Imbeleko Christian School (TICS) and the Parent(s) or Guardian(s) commit to cooperating fully and in good faith throughout the dispute resolution process to ensure a fair and equitable outcome.

This document represents the entire agreement between the parties concerning the student’s enrollment at Thari-Imbeleko Christian School (TICS) and supersedes any prior understandings or agreements, whether written or verbal.
